Najib Razak forgets that his mentor Mahathir Mohammad had signed a peace treaty with the Communist Party of Malaya.

So, not allowing Chin Peng to return home is indeed a “travesty of justice” as lawyer Darshan Singh says. 

Hostilities are supposed to have ended in 1989 after the peace treaty. It seems Najib does not understand what this means.

Would any country believe us anymore when we sign any treaties?

They better be cautious because we have a history of going back on our words.

It is not as if Chin Peng is coming back to set up a political party based on communist ideology.

The peace treaty did say they can come back to setup/join any legal political party.

The old guy wants to see his mother’s grave in Setiawan. His two kids can see him in Thailand or wherever. But nothing beats coming home.

This country does not belong to Najib or UMNO, not even MCA! Please dont act as if it’s your grandfather’s land!

Do we believe Ahmad Zahidi who said that 50,000 were killed by communists or do we believe historians, who said that it was about 2,000 but 7,000 communists died defending the country?

Think again!

Was Najib’s decision influenced by pressures from MCA as the party was once led by Kuomintang sympathisers who were always against the communist in China?

If Malaysia could pardon the British and Japanese who also killed scores of others in war time, why so afraid of the Malayan Communists?

UMNO seems really, really scared, perhaps of their own shadows?

    That is why foreign investors stay away. For the moment only the Arabs come (they also have tdm brains). The others include arbitration clauses in contracts so any disputes can be arbitrated in foreign countries.

    Should we also thanks the rampant thieves, murderers and corrupt people who will hasten the demise of BN? Maybe not now…maybe later in another timeline when history or perhaps, another lawyer makes it more palpable. (Sigh).

    Anyway, there is a clause in the treaty which states that the ex-CPM members should return within a stipulated period of time. So Malaysia did not relegated on the treaty. On another note, if the government cannot even acknowledge students with good grades how do we expect them to acknowledge deeds done in history? CP as an ordinary man is okay with me but if politicians want to exploit his standing, it is another matter. Sorry guys and gals, last posting on this matter by me. I am not anti-commies just no double standard as far as possible when dealing with personalities like CP.

    Japan is a country where like any other countries has critizens which opposed the war or sat on the fence, and those who wanted the war. We should not categorize all Japanese with hostility. The leaders that promoted the war and killings however should be held accountable. Japan and her leaders were humiliated and made to pay for the wars by the Allied Forces and until now, she still has to atone for the sins.

    If the question is why didn’t Malaysian government ask Japan for war compensation and apology. During the Japanese occupation of Malaya, Malayans in general did not see the logic of repelling another occupier from the current one (the Brits). So our fore-Malayans were rather friendly with the Japanese occupying forces and viz versa. However, the Japanese began targeting the Chinese Malayans and all ‘white’ folks because of the on-going wars in China and the Pacific. India stayed out of WW2. Like I commented earlier, it doesn’t mean that other Malayan races did not take up the patriotism together with MCP and the Brits to engage the Japanese force in a successful jungle warfare. However, modern day Malaysia did not see the need to diplomatically suffer Japan over WW2 since it will mean acknowledging MCP. Besides, Malaysia was one of the top choice of investment by the Japanese who felt Malaysia was a friendly country. If there is double standard, it wasn’t by me but the historians who re-wrote our history.

    First of all, Chin Peng WAS a communist (past tense). He IS NOT a communist as being called by some bloggers and even newspaper reporters.

    Second of all, these skeptics say that those who agree that Chin Peng should be allowed to come back to Malaysia, are trying to promote and resurrect Communism in Malaysia.

    Actually it isn’t something specific to the umnoputras. The Chinese and South Koreans occasionally bring up the issue of Japanese wartime atrocities , textbook controversy etc. And anti-Japanese sentiment is still high in China. So so much for your argument that this only an umnoputra thing.

    Actually not entirely true. The Chinese government since 1990 has been highlighting Japanese atrocities in textbooks with nationalist zeal. Thats why there was such an outrage over textbooks used by a minority of Japanese schools. Anyways i was saying that what you were saying of UMNO was not exclusive to them, but also practiced by other governments as well.

    And well Chin Peng’s application to return back has triggered the animosity here as well. Just look at the ex-servicemen and ex-policemen veteran groups. You didn’t think that they just instinctively hate Chin peng do you?

    The BN gov’s views are biased and Chin Peng’s views are biased. If you refuse to believe that the latter’s views are biased, than you yourself are. And just because one isn’t beholden to anything doesn’t mean one cannot be biased. One can be biased based on one’s views, political leanings, beliefs, upbringing etc etc. And although i admire susan’s posts against the BN government, she is indeed biased against them.

    But remember “many” does not equal “most”. We must examine the reports of both security forces killing civilians and the Commies killing civilians.

    For the record though, I don’t oppose Chin Peng’s return to Malaysia, as the Malaysian gov agreed to let him come home as a result of the peace treaty and by not letting him do so is highly unconscionable. I also personally believe that he come back and stand trial for his crimes. What I am opposing is people’s views that the CPM “weren’t so bad” and that the BN gov is the only government that refuses to let go of the past.

    In consideration of the CPM’s preparedness to give up their armed struggle, the Malaysian Government undertook to provide whatever aids possible and necessary to enable those who return “home” to quickly prepare them to quickly adapt, adjust and return to the civvy streets.

    Many were given land, aids to enter businesses and assisted to secure jobs. In fact, many of those who returned home have successfully turned over a new leaf. In fact, many are doing well in business today.
    I cannot now understand the furore recently drummed up by Rais Yatim and Ahmad Zahidi in attempting to demonising the past activities of CPM so as to stir up the ill-feeling of the rakyat. I find this form of futile and puerile exercise a blatant waste of time, efforts and public funds. And, it is disturbing coming from a veteran like Rais Yatim.
    I did mention somewhere in the cyberspace that the activities of the CPM did in no small measures expedite if not hasten the independence process as commented by the past defence secretary in Malaya, Sir Robert Thompson. Surprisingly, this signficant part of our history has been shamelessly censored.
    Ahmad Zahidi, our tyro Defence Minister, said that 50,000 were killed by the commies! Where in hell did he get this ludicrous statistics from?
    Now Chin Peng applied to come back to exercise his filial piety by paying respect to his dead parents.
    And, his application for return to his motherland was made so difficult that he was literarily made to crawl through the tedious, tortoise-slow and expensive court process to be slammed the door of no entry and no return. Are the hearts of our judges made of stone?

    But, some goons distorted his good intention by saying that his return was a security risk! What rubbish is this? Why did they not say Rashid Maidin’s and Shamsiah Fakeh’s return could have started a revolution?     Did not the CPM prove one important point after they surrendered? They did not create problems nor troubles nor disputes. They did not go back to the jungles to fight. They did not kill. Some Japanese were disagreed with their leaders decision to join the Axis Alliance. Besides, when US dropped two atomic bombshells in Nagasaki and Hiroshima, many innocent Japanese were killed. The legacy that we can see from these incidents is some Japanese suffer from genetic mutation.

    You say that Chin Peng may come back but must be judged and held accountable for what he did.

    Let me question you in return.

    Why the then Malaysian Government did not put Chin Peng and his comrade on trial in the first place?

    Why also that the government did not bring him and his comrades to the International Criminal Tribunal then?

    Then, why these people were pardoned at that time?

    The treaty does say that they may return to their homeland. So, why does the government want to violate this term of the treaty?

    And also, why Shamsiah Fakeh was allowed to return home ?

    The Home Ministry is now trying to justify its decision for not allowing Chin Peng to enter Malaysia because the High Court said so in its judgement. Passing the buck seems to be the order of the day not unlike the unwritten American Administrsative CYA Practice.

    The High Court based its judgement on the fact that Chin Peng could not at the material time present or produce his identification papers to substantiate that he was a national of this country. Hence, the door was slammed shut against the poor applicant.

    The Judge did not obviously look beyond the four walls of the court room to mete out appropriate justice to Chin Peng’s application. And to deny him his birth right to return to his Motherland for his failure to produce his ID papers is most unkind.

    The authorities could not expect all the communists who surrendered to be able to produce or possess the necessary ID. We cannot expect them to carry or possess such papers in the jungle? Even if they had, they would have over time be soiled, decayed, lost or defaced under the adverse jungle conditions. Certainly, this simple documentational requirement could be easily and amply met had the presiding Judge advised or directed the relevant authority to issue Chin Peng the necessary papers.

    At the point of signing the treaty, all former members of CPM had been granted a blanket amnesty. Hence, we should welcome them with open arms and treat them like any other citizen. Since we have pardoned them, les us continue to pardon and be pardoned – one of the greatest virtues ever known to humankind.

    The whole world once applauded Malaysia for having achieved the hard fought victory over the terrorists and now after two decades, we have been found to have shamelessly reneged on our words. What a disgrace!

    The authorities can easily issue, if they wanted to, Chin Peng a certified extract of his birth certificate and or his identity card to which service any citizen is entitled. What is the big deal man…?

    Thanks Witso for researching and coming out with Article 3 of the Peace Treaty signed between the Malaysian Government and CPM which provided CPM members who surrendered and laid down their arms the option of staying back in Thailand or returning home to Malaysia. Thanks Mosterball for commisserating with my thoughts.

    Let us take a look at this hypothesis. What would or could have happened to Chin Peng had he on the date of signing the Peace Treaty opted to return to Malaysia. Would anyone object to his return then? I am sure no one would dare to openly object. So, if no one objects then , why now?

    The May 13 Incident is a term for the Sino-Malay race riots in Kuala Lumpur (then part of the state of Selangor), Malaysia, which began on May 13, 1969. The riots led to a declaration of a state of national emergency and suspension of Parliament by the Malaysian government, while the National Operations Council (NOC or MAGERAN) was established to temporarily govern the country between 1969 and 1971.

    On 2 December 1989, the Government of Malaysia and the Communist Party of Malaya signed in Haadyai the written Peace Accords which consist of two portions, namely: –

    Agreement Between The Government Of Malaysia And The Communist Party Of Malaya To Terminate Hostilities

    The Government of MALAYSIA and the Communist Party of Malaya, consistent with their common objective for peace, hereby agree to the following :-

    ARTICLE 1 – CESSATION OF ARMED ACTIVITIES

    Upon the signing of the Agreement, the Government of Malaysia and the Communist Party of Malaya shall cease all armed activities forthwith.

    ARTICLE 2 – DISBANDMENT OF ARMED UNITS, DESTRUCTION OF ARMS, AMMUNITION, EXPLOSIVES AND BOOBY-TRAPS

    The Communist Party of Malaya shall disband all its armed units, destroy its arms, ammunitions, explosives and booby-traps in Malaysia and Thailand.

    ARTICLE 3 – RESIDENCE IN MALAYSIA

    3.1 Members of the Communist Party of Malaya and members of its disbanded armed units, who are of Malaysian origin and who wish to settle down in MALAYSIA, shall be allowed to do so in accordance with the laws of Malaysia.

    3.2 Members of the Communist Party of Malaya and members of its disbanded armed units, who are not of Malaysian origin, may be allowed to settle down in MALAYSIA in accordance with the laws of MALAYSIA, if they so desire.

    ARTICLE 4 – PROVISION OF ASSISTANCE BY THE MALAYSIAN AUTHORITIES

    With regard to Article 3, the Malaysian authorities shall assist members of the Communist Party of Malaya and members of its disbanded armed units in order to help them to start their peaceful life afresh.

    * The signing of the Agreement Between The Government of Malaysia And The Communist Party of Malaya To Terminate Hostilities was witnessed, with signatures affixed, by four (4) representatives of the Government of the Kingdom of Thailand, namely (a) Gen Chavalit Yongchaiyudh as Deputy Director, Internal Security Operations Command, (b) Pol.     The 1989 Haadyai Peace Accords (Part 2)
    The text of the Agreement Between The Government Of Malaysia And The Communist Party Of Malaya To Terminate Hostilities has been published in the immediately preceding entry headlined Haadyai Peace Accords in full text (Part1) in this blog.

    The text of the Administrative Arrangement Between The Government Of Malaysia And The Communist Party Of Malaya Pursant To The Agreement To Terminate Hostilities reads as follows:

    Administrative Arrangment Between The Government Of Malaysia And The Communist Party Of Malaya Pursuant To The Agreement To Terminate Hostilities.

    The Government of MALAYSIA hereinafter referred to as the Government, and the Communist Party of Malaya, hereinafter referred to as the CPM, hereby agree to the following Admistrative Arrangment for the implementation of the Agreement signed on 2 DEC 1989 in HAADYAI, THAILAND to terminate all hostilities.

    ITEM 1 – TERMINATION OF ARMED ACTIVITIES

    1.1 The Government and the CPM shall terminate all armed activities upon the signing of the Agreement.

    1.2 Press Statement

    All press statements issued by either Party thereafter shall be in the spirit of the Agreement and shall not contain any slanderous terms such as “mass surrender” and “capitulation”.

    ITEM 2 – DISBANDMENT OF ARMED UNITS

    2.1 Announcement of Disbandment

    The CPM shall disband all its armed units, namely the Malayan People’s Army (MPA) in MALAYSIA and THAILAND and shall announce the disbandment not later than two and a half months from the date of the signing of the Agreement.

    2.2 Nominal List

    The CPM shall furnish the Malaysian authorities with a nominal list containing personal particulars of its members and members of its disbanded armed units, who decide to take up residence in MALAYSIA, for purposes of verification by the Malaysian authorities. The list of such members shall be given to the Malaysian authorities as soon as possible, and in any case not later than one year from the date of the signing of the Agreement.

    2.3 Withdrawal From The Jungle

    All members of the disbanded armed units led by the CPM shall assemble at the pre-designated places in Thailand not later than two months from the date of the signing of the Agreement.

    2.4 Destruction Of Firearms, Ammunition And Explosives

    2.4.1 All members of the disbanded armed units shall destroy their firearms, ammunition and explosives not later than fifteen days from the date of their arrival at the pre-designated places in Thailand and not later than two and a half months from the date of the signing of the Agreement.

    2.4.2 The CPM shall provide the Malaysian and Thai authorities a list containg the description and quantity of such firearms, ammunition and explosives for purposes of verification before destruction. Such destruction shall be witnessed by the Malaysian and Thai authorities.

    2.4.3 Such destruction shall not be photographed or videotaped.

    2.5 Location And Destruction Of Booby-Traps

    2.5.1 Members of the disbanded armed units of the CPM shall locate and destroy all booby-traps in MALAYSIA that can be found, to be witnessed by the Malaysian authorities.

    2.5.2 The CPM shall furnish the Malaysian authorities with all existing sketch plans of the locations of booby-traps in MALAYSIA.

    2.5.3 The location and destruction of booby-traps shall commence as soon as possible and shall be completed without unnecessary delay.

    2.5.4 The Malaysian authorities shall provide medical treatment, allowances and compensation for any death or inuries suffered by members of the CPM’s disbanded armed units in the course of locating and destroying such booby-traps.

    2.5.5 All expenses incurred in locating and destroying the booby-traps in MALAYSIA shall be borne by the Malaysian authorities.

    2.6 Radio Suara Demokrasi Malaya

    The CPM shall within one month from the date of the signing of the Agreement close down the Radio Suara Demokrasi Malaya (SDM) station. During the period of one month, the SDM shall not broadcast any slanderous statement against the Government.

    ITEM 3 – PERSONAL BELONGINGS

    All personal belongings including souvenirs, photographs and other daily necessities of members of the CPM and members of its disbanded armed units, the possession of which is not unlawful in MALAYSIA, shall be retained by them after inspection before their entry into MALAYSIA

    ITEM 4 – RESIDENCE IN THAILAND AND FREEDOM OF MOVEMENT

    4.1 The Malaysian authorities shall not object to members of the CPM and members of its disbanded armed units taking up residence in THAILAND.

    4.2 Those who have settled down in THAILAND are free to enter MALAYSIA through legal means to visit their relatives, friends and for vocation.

    4.3 Those who have been allowed to settle down in MALAYSIA are free to visit their relatives and friends in THAILAND through legal means.

    4.4 Relatives and friends of those who have settle down in THAILAND and MALAYSIA shall be free to visit them in either country through legal means.

    ITEM 5 – RESIDENCE IN MALAYSIA

    5.1 Members of the CPM and members of its disbanded armed units shall be allowed to take up residence in MALAYSIA if they so desire, after they have stayed in the pre-designated places in THAILAND for a minimum period of six months.

    5.2 Members of the CPM and members of its disbanded armed units, who are not of Malaysian origin, may be allowed to take up residence in MALAYSIA, if they so desire, after having stayed in the pre-designated places in THAILAND for a minimum period of six months.

    5.3 Those who seek to settle down in MALAYSIA must notify the Malaysian authorities of their intention to do so not later than one year from the date of the signing of the Agreement.

    5.4 With regard to Item 5.1 and 5.2, the CPM shall provide the necessary particulars to the Malaysian authorities for processing and verification. In this connection, the Government shall despatch relevant officers to deal with those cases in THAILAND.

    5.5 Those who wish to settle down in MALAYSIA shall be categorised as follows:

    5.5.1 Malaysian citizens

    5.5.2 Non-citizen spouses and children of Malaysian citizens, and

    5.5.3 Aliens

    5.6 Those who are allowed to settle down in MALAYSIA shall be given identification papers upon their entry into MALAYSIA before they proceed to their respective places of residence of their choice.

    5.7 Non-citizen spouses and children of those who are of Malaysian origin may be allowed to settle down in MALAYSIA in accordance with the laws of MALAYSIA if they so desire.

    5.8 Those who have taken up resudence of their own choice in MALAYSIA shall notify the MALAYSIAN authorities of their current addresses to facilitate disbursement of financial assistance.

    5.9 Those who are allowed to settle down in MALAYSIA shall be taken into the country in small batches and any search that may be conducted shall be in a manner so as not to cause any embarrassment.

    5.10 There shall be no publicity of their entry into MALAYSIA.

    ITEM 6 – LEGAL REQUIREMENT

    6.1 Loyalty to King And Country

    Members of the CPM and members of its disbanded armed units who have returned to settle down in MALAYSIA shall be loyal to the King and country and shall abide by the Federal Constitution and the laws of MALAYSIA.

    6.2 No Detention, Interrogation Or Prosecution

    6.2.1 The Government shall not apply the Internal Security Act, 1960 or any other laws on members of the CPM and members of its dibanded armed units who have returned to settle down in MALAYSIA, for their past CPM-related activities.

    6.2.2 Members of the CPM and members of its disbanded armed units shall be liable under the laws of MALAYSIA for any unlawful activities committed by them in the future.

    6.3 Citizenship And NRICs

    6.3.1 Those who were in possession of Blue and Red NRICs and citizenship certicificates before they joined the CPMs or its armed units shall continue to use them as valid documents. Any such documents which have been lost or damaged shall be replaced expediently after verification.

    6.3.2 Non-citizen spouses and children of those of Malaysian origin who have settled down in MALAYSIA shall be issued with RED NRICs. They can apply for citizenship after two years of continuous stay in MALAYSIA in accordance with the laws of MALAYSIA.

    6.3.3 Those who are aliens and those whose citizenship have been revoked shall be issued with RED NRICs should they be allowed to settle down in MALAYSIA. They can subsequently apply for citizenship in accordance with the laws of MALAYSIA.

    6.3.4 Those who are of Malaysian origin and who joined the CPM and its armed units before the implementation of the National Registration, shall be issued with RED NRICs should they be allowed to settle down in MALAYSIA. They can subsequently apply for citizenship in accordance with the laws in MALAYSIA.

    6.4 Privileges And Obligations

    6.4.1 Those who are Malaysian citizens and have settled down in MALAYSIA shall enjoy the same privileges as any other citizens under the Federal Constitution and the laws of MALAYSIA.

    6.4.2 Those not of Malaysian origin and non-citizens who have settled down in MALAYSIA shall be governed by the Federal Constitution and the laws of MALAYSIA.

    ITEM 7 – PARTICIPATION IN POLITICAL ACTIVITIES

    7.1 Members of the CPM and members of its disbanded armed units who are Malaysian citizens are free to participate in political activities including the formation of a political party or parties within the confines of the Federal Constitution and the laws of MALAYSIA.

    7.2 The Malaysian authorities shall expeditiously consider any application that may be submitted by them for the registration of any political party in accordance with the due process of the law and upon registration such party shall be accorded the same status as any other legally registered political parties.

    ITEM 10 – SIGNING OF AGREEMENT AND ADMINISTRATIVE ARRANGEMENT

    10.1 The Agreement and the Administrative Arrangement shall be signed separately at pre-determined venues agreed by both sides.

    10.2 The Agreement shall be signed by both sides in public and the spirit of this Agreement shall be announced in a Joint Communique immediately after the signing.

    10.3 The Administrative Arrangement shall also be signed by both sides but it shall not be publicised.
