“It is imperative that this honourable court determine if (P) Balasubramaniam’s statement is indeed true and if so, whether it is imperative he be recalled and for Najib (Tun Razak) to be summoned as a witness”.

Karpal Singh is trying to summon Najib and Bala to court to testify in the Altantuya Shariibuu trials.

It was done according to Section 425 of the Criminal Procedure Code.

The question is: Will Najib eventually get to say he is innocent in court? 

And where is the elusive Bala?

Karpal feels that Najib “appears essential to the just decision of the case”.

What about Prime Minister Abdullah Ahmad Badawi and his son-in-law Khairy Jamaluddin?

Blogger Raja Petra Kamaruddin declared that both were handed the evidence linking Najib’s wife Rosmah Mansor to the Altantuya killing for safe-keeping.

Will the honourable court also determine if Raja Petra’s statement is true or false?

Or have the authorities decided already?

Isn’t it essential that Pak Lah and KJ also get to have their day in court?

Rumours flying around about these top personalities in our country simply ain’t good for a nation approaching 51.

    The “Authorities” have already made it quite clear that there is ONLY 3 people involved and those 3 are already in custody.

    The DPM’s name MUST not be mentioned. The judge & the prosecution that mentioned that name very very early in the trial have already been replaced.

    The above statement is on record and can be easily veried.

    The next question is “who is hiding Bala and will he be called to testify?”. I guess he will only be called to testify if he has the “right” answers.

    The thing that I don’t understand is the 3 accused have not been put on the witness stand and questioned under oath yet. I guess if Karpal is worth his salt he will have a field day questioning the accused.

    The BIG question “who gave the order” has not yet been asked. Isn’t this amazing !!

    They cannot be denial easily to reporters and published in MSM. They have to testify in court as their names was mentioned in RPK SD.

    Those mentioned in the SDs made by Raja Petra and PI Bala must appear in court. Any attempt to to avoid the truth with the help of the PM is deem guilty. Those in high office have been telling DSAI to surrender his DNA and the rakyat want to hear the same call for those mentioned in Altantuya’s murder case to do likewise. What is there to be afraid if they are not a part of it? Unless they have no faith in the very court that the government has held in high esteem.

    U can bet your life on it – he will definitely NOT be summoned to testify. When an allegation is made against UMNOputra’s the immediate response from the powers that be is “THAT’S A LIE”. But when any allegation is made against the opposition / their supporters it must be the truth. That’s justice in Malaysia for u.

    Did they even investigate RPK’s SD? The trial is ongoing and the persons implicated had never been called to testify, so how do they know its not true?

    Despite all the evidence to the contrary, they must think we are all as dumb as they are if they expect us to believe that civilians have access to C4 bombs. Wish that was true. I have a list of people in BN that I would LOVE to blow up.

    Dear Susan,

    It’s an interesting, yet flawed question. The Malaysian judicial system is based on the adversarial style where the Court is limited to the evidence adduced by the two parties (prosecution & defense) and cannot go on its own whim and fancy to become “investigator”.

    Raja Petra’s allegation through the SD was already investigated, and he was charged with criminal defamation for it, indicating that the Prosecution has evidence the SD is false or partially false.

    To summon anyone just mentioned in the SD would tantamount to acceptance of one man’s version without investigation. Would it be logical then to assume that whatever RPK wrote is the truth, the whole truth and nothing but the truth?

    Imagine if RPK were to mention your name, just for the sake of it. The police investigated, found no truth in it. Should the court then (which they can’t anyway) just call you up just to clarify one man’s claim? Imagine the foolishness if the court’s started calling everyone based on hearsay allegations.

    Imagine then if suddenly Najib starts claiming that Anwar, RPK, Azmin Ali, Wan Azizah, Lim Kit Siang was also involved in the Altantuya murder (all through our infamous SD). Would the Court then also be compelled to call all this people just because one man claimed they should?

    That is why Karpal Singh limited his summons to Najib and Bala. He is not that stupid.

    Interesting questions, but ultimately showcased the lack of understanding of our judicial system.

    The courts are confined to the evidence adduced before the courts by the two parties. The courts are NOT supposed to act on its own frolic, becoming its own investigator and CSI.

    RPK’s SD was already investigated, and he was charged for criminal defamation for it. Must the court then assumed RPK’s SD is the truth, the whole truth and nothing but the truth?

    Imagine then if our courts start to call up witnesses based on “claims” and “allegations” made by the public. Imagine then if Najib starts “declaring” that Anwar, Azmin, Wan Azizah and RPK are all involved in the case. Would you then support the court to call all these personalities too? If not, why should KJ and Pak Lah be brought to the stand? And if yes, what’s stopping Anwar to “declare” that Tun Mahathir, Muhkriz, Musa Hassan etc are also involved?

    Can’t you see the preposterousness of the whole exercise?

    It doesn’t take a genius to figure this one out. That’s why even Karpal Singh was smart enough to ask for Najib & Bala only.

    To believe that Najib will be dragged to court in this case is only in the possibilities that AAB given a green light to the judiciary and cooped the UMNO Warlords. In the absence of AAB’s (stealth) approval, for one to think of Najib appearing in court is the same as pushing a car up a hill.

    The MOngolian Government should itself, not through the mouth of Setev to sever ties with Malaysia if the outcome of this trial is not fair.

    That`s thinking weird. If Najib wants to draw them in then it`s up to him. Let him do it. The courts are always there.
    Here RPK is accused. So it`s for them to prove that RPK is guilty, not for RPK to prove that he`s innocent. To do that he will produce his `informant`. That`ll be interesting.
    Bala was a witness in the Altantunya case. He subsequently made a SD which was retracted within 24 hours under extremely dubious circumstances.

    While scientists the world over have extracted and reliably used DNA from over tens of thousands of years ago, our local saintis kampung in the form of Abdullah Ahmad Badawi says that ten-year-old DNA samples are no good and that they need fresh DNA from Anwar.

    Genetic experts should weigh in on the range, by way of confidence intervals for example, on how precise the age of a DNA sample can be pinpointed.

    For example, if they have Anwar’s DNA from 10 years ago and tried to plant it as evidence, it may clearly be debunked using objective tests that indicate a sample obtained from a time period not corresponding to the time that Saiful says he was sodomised. (i.e., DNA does indeed disintegrate over time, yet does not lose its ability to ‘finger print’ the individual).

    On the other hand, fresh DNA might fall within a range of estimates for the time period corresponding to Saiful’s allegation.

    That may be why the government and the police are increasingly desperate to obtain fresh DNA samples from Anwar, so that if planted, it becomes very uncertain exactly when it was ‘deposited’ into Saiful’s posterior, with the actual planting of evidence becoming indistinguishable from the alleged act of depositing semen by way of sodomy.

    You see, they asked a certain doctor from a certain hospital to conduct an examination on Saiful. The doctor did so and he came out with a report that said there is no evidence Anwar had ever penetrated or sodomised the young man. The police then picked up the doctor and detained him for three days. As much as they tried to force him to change his report to implicate Anwar he refused to do so.

    Until today, the doctor stands by his report that there is no evidence Anwar had sodomised Saiful. He knows he is going to be made to pay for this but he doesn’t care. He is not going to change his report and say that Anwar sodomised Saiful whatever they do to him. Exasperated, the police had to release Anwar on personal bond or police bail. The doctor refuses to doctor his report and neither does Anwar want to volunteer his new specimen.

    The ‘evidence’ against Anwar is no good. They now need to look for another way to ‘prove’ that Anwar sodomised Saiful. In the meantime, let us see if the AG will be making another police report against me and whether the IGP is going to arrest me and charge me in court for sedition and criminal defamation for this latest allegation of mine.

    Hey, I already face four charges of sedition and criminal defamation. What are another two or three charges? The important thing is not whether I get sent to jail or not. What is important is that the world is told that they are attempting, yet again, to fabricate evidence against Anwar Ibrahim. And that is worth going to jail for.

    There is a BIG VERY BIG difference if Pakatan and DSAI comes to power vs the current BeeEnd power structure and you should highlight it in your blog.

    If DSAI ever comes to power, people should not worry, because DAP and PAS comes to power also as EQUAL partners. Lim Kit Siang and Tok Guru will not just let DSAI do as he wants.

    This will truly be a check and balance govt. Likewise , PAS cant do as they want without angering DAP and also DAP cant do as they want without angering PAS. Because if any of the 3 walks out of Pakatan, Pakatan Rakyat will fall as the Govt.     1)Altantuya’s friend on the the witness stand in court who claimed to witness Najib photographed with Razak Baginda and Altantuya and the erasure of the immigration records.

    2) Bala’s SD1 implicating Najib and the sudden amendments by omitting Najib
    in totality in SD2 in less than 2 hours.

    Even Bill Clinton couldn’t escape from justice when he was grilled hundreds of hours by Kenneth Starr when his only crime was let himself to be “hisap” by Lewinsky when oral sex in the US is not wrong at all.

    He said he does not know Saiful, did not meet him and then he met him, and hold his hand. If this is uttered in court, he will be caught for lying. So, since he can’t debate with anwar and would probably get himself in jail for incosistency, the verdict is that the Malaysian court will not summon him.

    2) membina satu masyarakat progresif yang akan menggunakan sains dan teknologi moden – Are we actually going after teknologi moden by sending our “space tourist” into outer space to main gasing and bancuh teh tarik? And our PM does not even have the basic scientific knowledge when he said that Anwar’s DNA samples taken 10 years ago is “outdated” and they need fresh samples. Mind you scientists can even DNA from mammoths to do research and are the DNA “outdated”, considering the fact that the mammoths became extinct thousands of years ago. So is DSAI thousands of years old?

    Everyone knows the whole purpose of obtaining fresh DNA samples. UMNO is trying to put on the pants before putting on the underwear. How can the police report from the “sodomized” victims be not out by today and the police is already demanding for DSAI’s DNA. Sounds fishy doesn’t it?

    In a neutral law-court and in a neutral perspective, to subpoena AAB and KJ based on the SD by RPK is a non-starter. For the records, Raja Petra was not a witness in the Altantuya’s trial. Bala is (a witness) and his contention was that the omission of Najib Razak’s name when he signed the police report where he allegedly told the police investigators what Razak Baginda told him-that DPM Najib Tun Razak was the one who introduced Altantuya to him and has anal intercourse with Najib according to Bala and such questions had not being raised by the DPP.

    1) RPK refused to tell who was the informant in his SD on grounds that certain VVIP’s wife, an army and his wife’s presence on the good grounds that the one who confided in him will face reprisals. Fair at this point. The question is if you cannot even have any evidence or probabilities to evidence likewise, photographs, the confider, etc. how could any court-of-law taken your account as facts that merited in his SD that the events merits the named person/s to be admissible by evidence?

    I know your will is good, but unfortunately, I don’t see RPK’s SD credible.

    If you are on the witness stand In court , you are required to answer the question put to you by either the prosecution or defense lawyers or the judge, no more, no less.

    It is only Perjury if you provided a false answer to questions posed.
    If you say anything more than what is asked from you, it may be struck from the court records, worst case you can be charged with contempt of court.

    In the Altantuya trial, both the prosecution and the defense studiously never asked any question on the subject covered in Bala’s SD, even though he says he provided the police with the information during the investigations.

    Anwar’s current case is nothing but a conspiracy and a politically-motivated one. Every single thing that has come to light has only strengthened my belief.

    The accuser met the deputy PM before he lodges a report and also apparently before the last alleged sodomy incident took place. It took days the deputy PM to admit to that fact.

    Anwar is being denied a copy of the police report – despite it being public knowledge that his accuser ten years ago changed his statements to fit discrepancies that came up. The list goes on.

    There is no denying too that it is a risky move to charge Anwar with the same so called crime. Whoever planned this probably knew that a lot of people will think that it is a frame up.

    But I am guessing that this person did not have much of a choice. To put it simply; the excreta was about to hit the roof.

    A weak PM, an embattled deputy PM, a thwarted son-in-law, a disgruntled ex protégé and an ex-PM who’s about to see his deepest nightmare come true; if this was a fictional whodunit there would be plenty of suspects desperate enough, and yes ‘stupid’ enough, to come up with the idea.

    But I don’t think such facilities exist in Malaysia.

    To protect himself as best as he can, Anwar should insist in internationalising this investigation. E.g. Any blood sample taken from him must be sealed and sent to a mutually agreeable certified DNA lab overseas, say another Commonwealth country. Australia has very good and respected DNA testing facilities.
    If AAB himself is involved in this controversy, I’m afraid there is NO laboratory and laboratory personnel in Malaysia who can be trusted to safeguard the samples.

    It’s true there are so many possibilities. The fact is they already have record of DSAI DNA which is i believe is in the physical form for our human possible eye comparison. The many possibilities of this CONSPIRACY requesting for new DNA is obvious that the previous DNA is tainted with those involved in the previous case or probably all used up or perhaps DOLLAH can provide more relevant excuses. Should the previous DNA being tainted then it will show in a new test for the current case. That’s why they keep insisting for new DNA specimen.

    “DNA isn’t the answer. Often it’s the problem.”

    The double helix genetic compilation known as DNA has become a double conundrum for rape victims in seeking justice in the courtroom. The problem stems from the public’s fascination with DNA and crime.

    “People expect DNA or scientific evidence in every case and the reality is it doesn’t exist in most cases,” Sangamon County Assistant State’s Attorney Sheryl Essenburg said. “It’s very much the exception.”

    In fact, the Federal Bureau of Investigation reports that DNA is available in only 10-20 percent of cases. Therefore, DNA isn’t the silver bullet the general public expects and often it’s not even available to be fired.

    However, its presence or lack thereof is still a key issue at most jury trials. The jury expects DNA or scientific evidence, and the prosecution must educate the jury during each trial on the hazards of over anticipating the importance of science.

    “It’s a hurdle that in every jury trial we have to address, especially in child sexual abuse cases,” Essenburg said.

    Its presence is becoming an issue in adult cases as well. The case involving the Duke lacrosse team became a national debate when 46 of 47 team members were required to submit to DNA testing. When DNA matches were not found, the defense quickly jumped to the conclusion that a rape hadn’t occurred.

    “That leap is a misunderstanding of what DNA can and can’t prove,” said Michelle Anderson, a law professor at Villanova University. “DNA can prove sex occurred. DNA can’t prove that sex didn’t occur.”

    The DNA conundrum adds to the obstacles against victims achieving justice in the courtroom. It falls in the same category as the beliefs that victims of sexual assault are always physically injured during the assault.

    “This focus on DNA evidence seems to be in the historical line with the requirement for physical force,” Anderson said. “Rape cases are frequently low priority for prosecutors. They see them as difficult to obtain a conviction. Prosecutors are more concerned about their won-loss record than serving the victim of rape in a community.

    What is true across different jurisdictions is that prosecutors and police exercise particular scrutiny with rape victims that is historically excessive and today continues to be excessive.”

    Why isn’t DNA there?

Despite what television portrays, DNA and other scientific evidence isn’t waiting patiently to be snatched up and raced away for testing by a lab technician. The majority of victims do not report to the hospital so DNA evidence isn’t collected. And if a victim reports to a hospital, time can alter the findings.

    “DNA is only available when it has been reported after a few hours, not just DNA but any scientific evidence,” Essenburg said.

    Even if DNA is available, it can also be compromised throughout the chain of evidence, which often ventures into weeks and months instead of hours.

    “DNA evidence degrades rapidly,” Anderson said. “It is difficult to contain efficiently and handle effectively.”

    Also, there are simple reasons for the absence of DNA. The rapist may not have ejaculated inside or on the body of the victim. The rapist may not have ejaculated at all. The assailant may have used a condom during the attack. The assailant may have used an object to assault the victim.

    “People don’t understand that. They think rape is always a sexual act when it’s often about power and controlling someone else,” Anderson said.

    Stranger vs. Acquaintance

    The greatest benefit of DNA to rape victims comes in stranger rape cases. DNA samples can be used to match with convicted offenders or help string together evidence in a serial rape case. This benefit with DNA and stranger cases produces the unintended consequence of strengthening the rape myth that all rapes are committed by strangers. In fact, only approximately 20 percent of rape cases are stranger cases.

    If DNA is found in acquaintance rape, the assailant simply states that the sex was consensual, negating the DNA evidence.

    The impact of DNA differs greatly depending on the age of the victim. If the victim is a child, DNA evidence can be especially beneficial in the courtroom. However, it’s rare that DNA is involved because the reality is that most child victims wait several days or years to inform law enforcement about the sexual violence. Essenburg has never tried a child sexual abuse case that included DNA findings.

    “If it’s there, particularly in a child case, it’s fabulous,” Essenburg said. “In an adult victim case, if it’s there it doesn’t eliminate the issue of consent.”

    And consent still rattles the cage of most juries. If DNA is found, the assailant claims consensual sex. If DNA isn’t found, the assailant claims there wasn’t an assault. It comes out to the assailant’s advantage in most cases.

    “Some people have the assumption that DNA evidence is going to be there and if it isn’t, people assume that the victim is lying about the case,”

    Anderson said.

    Deciding who is speaking the truth in rape cases is at the crux of most rape verdicts.

    Words vs. Science

    “Victim testimony in rape cases has never been a slam dunk for women,”

    Anderson said.

    “Historically prosecutors want bruises, broken bones, evidence of physical force. The narrative of he said, she said is all about rape cases. Her voice has never meant as much.”

    In a time when too few rape cases are prosecuted, the lack of DNA can provide an excuse for not prosecuting a case. Prosecutors and the public need to remember that rape cases were tried prior to DNA evidence and still need to be tried with or without DNA support.

    It’s important to remember that DNA is a single part of the evidence collection. If the victim goes to the hospital, a multitude of evidence is collected during the forensic medical examination (rape kit) that is performed by medical personnel.

    “The media so plays up the scientific wonder that some people forget that it is who you believe,” Essenburg said. “We have to remember as prosecutors and jurors need to understand that it’s going to be there in some cases and in other cases it’s not going to be there.”

    As usual in discussing rape or myths about rape, education will play a key factor in turning the tide about what DNA can and can’t do for rape victims.

    “The work to publicise DNA evidence is really helpful but it’s not going to have the impact that CSI will,” Anderson said. “People need to challenge the shows … They need to put pressure on the popular shows to talk about these kinds of issues.”

    We offer below a short brief on DNA as an idiots guide to the correct medical procedures to be followed in cases of alleged sodomy. It is grounded on back to basics forensic medicine, founded on evidence and not emotions.

    1) If the alleged victim claimed “the latest violation” on 26th June 08, had “counsel on 27th June 08 and reported to police on 28th June 08, it is highly likely that nature’s most efficient plumbing system would have flushed out whatever foreign fluids and tissue deposited within that most currently spoken of orifice. Almost all humans need to answer the big call at least once a day!

    2) Notwithstanding the above, if indeed the alleged accused’s specimen was obtained from the ‘hole’, it would be imperative to verify the authenticity of the collection to ensure no foul play was involved in collecting the specimen.

    3) DNA from the sample obtained in (2) can then be readily compared with the DNA fingerprint of the accused, assuming his DNA profile from the last trial had been safely archived. That is the role of the National DNA Database. It is hence nonsensical for the incessant calls for the accused to give his fresh blood to perform a match with the sample from (2). Unless of course in typical Malaysia Bolehland fashion, the accused’s DNA fingerprint records have gone missing! This then does not speak well of the professionalism of the investigating team. But then again it is but a recurring theme in so many other investigations of late.

    4) The prime minister and the deputy IGP, amongst others have insinuated that old DNA from 10 years ago is of little or no use in the current saga. Let it be known by all and sundry that there is no expiry of DNA. For purposes of DNA fingerprinting alone, even the Jurassic dinosaurs DNA can be analysed, unless of course there is a sinister intention for use of the accused’s fresh DNA that is almost unthinkable.

    Last weekend I had a conversation with an NGO activist who has been working with social groups to have better support and justice for rape victims. She’s absolutely livid over the Saiful case.

    The sight of the Government trying to pursue a dodgy case which almost nobody believes has set back the cause of genuine rape victims for decades.

    Saiful may or may not be a genuine victim, but this case really takes us back to the bad old days when victims who reported rape were treated with suspicion, without any support, and convictions were very difficult.

    Komen Berasiam: Selain 32 cawangan di Gua Musang yang meluluskan usul, sebuah cawangan di Pandan Selangor juga telah meluluskan usul yang senada, mencalonkan selain Pak Lah sebagai Presiden. Usul cawangan di Pandan bukanlah usul tergempar, tetapi usul bertulis yang dimuatkan dalam kertas persidangan.

    Komen Hairul AS: UMNO Bahagian Pandan juga tidak akan mencalonkan AAB sebagai Presiden Parti.

    Malaysians are to be partially blamed for the high-handed approach adopted by BN government in handling the current affairs in Malaysia.
    1) Not many know “real human rights”
    2) Not many can analyse the issues well. Easily confused by BN government counter-statements in local newspapers
    3) Not many can stand firmly on the issues
    4) Many can be easily convinced by BN government the affairs BN governmenet wants to meddle with as “internal affairs”
