Serve you all right for your “insidious movement” to involve your (not so good) selves in the appointment of judges, especially the appointment of Ahmad Fairuz as President of the Court of Appeal and later Chief Justice.

Yahoo ! Malu ! Malu ! Malu ! Shame ! Shame ! Shame !

But wait a minute…will anything come out of the 191-page Lingamgate report, released by the government today? Fat hopes ! As I read the news … gone are my high hopes …

“The report is advisory in nature so (the AG) will have to investigate them later” (Law minister Zaid Ibrahim).

It sounds just like previous SUHAKAM (National Human Rights Commission) reports which never saw the light of day. They were never raised or debated in Parliament, nor were they ever paid heed to by the government, rendering the human rights body a ‘toothless tiger”. But we never meant to give them “teeth”, said the government.

Then came another blow … guess who is the AG (who has to investigate the matter) ? Lawyer Haris Ibrahim echoed my exact sentiments when he said…“Good Lord, no!” – coz it’s the notorious Abdul Gani Patail !

This chief legal officer of the government, with no evidence, had a hand in denying us the use of indelible ink at the last elections.This same officer was also seemingly eager to find at the earliest that there was no wrongdoing disclosed in the Lingam video! He was probably all in favour of a NFA ( no further action )!And he’s to now investigate Dr M and the others implicated!

His notoriety is known in other cases, for example, the Altantuya’s case and alleged corruption of ministers and police force:

And on July 27, Attorney General Abdul Gani simultaneously absolved both the Inspector General of Police and the former Director General of the Anti-Corruption Agency of spectacular corruption charges just two weeks after he had done the same for the deputy minister of internal security, the cabinet member in charge of the police force. These cases have kicked off a firestorm in Malaysian cyberspace, with bloggers scornfully charging that the judicial system is corrupt (Asia Sentinel: Rot and More Rot in Malaysia’s Judicial System).

In fact the man’s reputation goes back as far as the controversial Anwar Ibrahim trials:

Abdul Gani Patail is today tapped as Malaysia’s top legal officer. The legal fraternity, and the rest of the country, cannot but be flabbergasted by this astounding appointment.

This is, after all, the man – who as chief prosecutor in former deputy prime minister Anwar Ibrahim’s trials – was unable to get the dates of the alleged sodomy acts right, not once but twice. This is the man who was responsible for parading the infamous semen-stained mattress during the court hearings (Steven Gan).

Need I say more?

Justice itself has fallen victim with this appointment (of Gani as Attorney General). Whatever hope there may have been for change has been brutally reversed. Sadly, it is back to the bad old days. This appointment has starkly emphasised the government’s complete contempt for public opinion and for our shared values in the notion of fairness and justice.

Aliran President P Ramakrishnan may have said this in November 2001, but how it still rings true until today.

Should we give the AG and the royal commission Lingam report a chance? You tell me !

    Gani is a 3rd class pass who`s not fit to be an AG:

    The comments by the Attorney-General Tan Sri Abdul Gani Patail that “no criminal offence appears to have been committed” in the Lingam Tape and that senior lawyer V.K.Lingam “was in a monologue over his mobile phone and it was unclear who he was talking to” (New Straits Times) were most outrageous and raise important questions, viz:

    * his understanding of and commitment to judicial independence, integrity and accountability; and
    * his fitness to continue as Attorney-General.

    How can the chief legal officer of the government try to minimize the gravity of the judicial misconduct exposed by the Lingam Tape and shirk off his responsibility by claiming that Lingam was in a monologue as “There is no clear reference that he was talking to a top judicial officer”, when Anwar Ibrahim’s allegation that Lingam was talking to Chief Justice Tun Ahmad Fairuz Sheikh Abdul Halim sometime in 2002 when he was Chief Judge of Malaya was corroborated by the contents of the conversation?

    Gunni Petai do wat his boss asked him 2 do wat. To charge or not to charge? That is not his perogative. Foreigners doing biz with locals in M’sia had long insisted that in case of dispute, foreign law will be used to settle dispute. They knew law in M’sia can be bought and they do not want to play this game. Cannot say justice has been served until real reforms take place and culprits be brought to justice. And do it fast.

    The immediate concern is the threatened resignation of two top prosecutors, Yusof Zainal Abiden, the head of the prosecution division, and Sallehuddin Saidin, the deputy prosecutor and head of the classified cases unit. Although the Attorney General’s chambers denied the two were resigning, they later said they were applying for “optional retirement.”

    The AG now has a mamoth task to bring these people to book, otherwise it is going to be shameful on himlah.

    PakLah in the meantime must lodge a polis report against all those implicated and ensure they are tried under the Seditions Act and may put he book on them under ISA.

    The BN MPs in the meantime all lodge reports and table this in the Parliment to expediously bring all to jail.

    Then and only then BN can rise again, otherwise BN is Barisan Nothing.

  20. First of all, kudos to the commission for not being swayed by the myriad of lies that were spouted by Lingam and his cronies.
    Apparently some of these bigshots have now gone overseas, no doubt to plan their next moves.
    The people still hold a glimmer of hope that Gani Patail will act justly & not become a traitor and cowardly throw cold water on the whole thing. Perhaps PM will instruct him to do the “right” thing now especially when he has a huge axe to grind with Mahathir.
    We’ll see.

    Gharni has in cohort with Mahater for a long time. Even during DSAI court case time. They had been in long discussion on how to nail DSAI. Gharni practically reports to Mahater.

    And now, Gharni has been selected to investigate and possibly prosecute the gang of 6, Mahater included.

    How is that possible, I don’t know. The 6 are practically within his circle of friends. So how can he investigate and if found guilty, prosecute them too?

    I don’t see this happening, unless Gharni is not the one doing the investigation. It’ll just be another round of wayang kulit. In the end, after months of investigation, he’ll declare ” NOT ENOUGH EVIDENCE TO PROCECUTE” and the case is dropped.

    Gani Patail was sitting upstairs while Anwar was being beaten up by the ex-IGP downstairs at about 9 pm that fateful evening. It`s inconceivable that Gani did not know of the beating.
    When the ex OCPD, M`cca investigated the beatings and gave a `clean` chit, Gani never came forward to tell the truth.
    It took a Royal Commission to clear that up.

  37. Most of the Government appointees have credibility issues. Unles the Govt brings in international or local professionals with impeccable credentials and reputation, this will simply be another kangaroo court.

    The people I have in mind are Aung San Suk Yi, , Lim Kit Siang, Karpal Singh, Lim Guan Eng. Most have suffered under unjust regime and spent years in prison. They will know what to look for.

    As long as we have Umnoputras at the helm, it’s all like a ‘Broadway show’ in New York.

    Frankly speaking, if we want to live peacefully and harmoniously together, all the corrupt, nepotistic Malaysian politicians must have to be sent to the deserts in Arab or a no-man/woman island.

    You know why? After 50 years of playing dirty politics in Malaysia, all these politicians are just rotten to the core and nobody could cure/save them to become pure/ right again- not even Jesus, Mohammad or Buddha…..

    Why did the Queen of England want to send all the England endemic convicts to Australia during the Victorian time??     (3) Abdullah AB formed the “Haidar Cimmission of Inquiry”

    (5) Abdul Ghani Patail (no right minded person trust this man) pursues an investigations (whom prior to the “Linggamtape” he claimed the allegations were unfounded), an act on the perpetrators.

    (6) Now, isn’t it clear that this seems to be “premeditated” by AAB’s “shadow-plays” esp. to get Mahathir?

    My questions is will AAB is under any advices from Anwar Ibrahim as both has different kinds of hatchet against Mahathir? (one chooses to be reticent the other chooses to have forgotten the old man).

    To indict the wrongdoers is and will be the greatest honour one can repatriate to the state of Judiciary and Loh Gwo Burne must be thanked for his work.

    For me, it’s more like Abdul Ghani Patail against AAB, and in the shadows
    Mahathir Mohamad against Anwar Ibrahim. I don’t think I am wrong on this!

    What an earth-shaking news it is. It appears that something is really rotten in this country. Mind you, what is at stake here not only are the integrity and reputation of the above six magnificent individuals but also the whole value system of Malaysia. Why? For the simple fact that these Magnificent Six were at one point of time (one or two still are or still believed to be) the Captains in their respective fields, i.e. politics, judiciary and business.

    Lest us forget that the Magnificent Six are entitled to be presumed innocent until proven otherwise. Moreover, proper and thorough investigation is still yet to be commenced. In the name of justice, they must not be unfairly subject to the trial by the media or public perception. Yet, at the same time, there must not be any doubt whatsoever that the cardinal legal principle of Equality before Law is compromised due to their status or reputation.

    In view of the possible explosive impact of such investigations to the Malaysian society at large, we, the ordinary Rakyat, have every rights to demand nothing less that a speedy as well as “leaving-no-stones-unturned” sort of thorough investigation. Needless to say, anything short of that demand or expectation could have catastrophic effects on the Government of the day. Hence, PLEASE NO FLIP-FLOP IN THIS INVESTIGATION.

They are respectively set out in the four different settings, namely 1. The Main Report, which is very important and vital, 2.Notes of Proceedings, 3. The Statutory Declarations made by all concerned and lastly 4. The Exhibits submitted.

He points to the Federal Court’s affirmation of the RM10 million awarded to the Berjaya Group supremo and Big Mac chief, Tan Sri Vincent Tan. Dato’ Rais’ remarks, made when a Bar Council committee called on him on 04 September 00, castigates the Chief Justice (more popularly, Big Chief Injustice, in legal circles), Tun Eusoff Chin, and in terminal shock after He Who Must Be Destroyed At All Cost mercillessly castigated him for his corruption, bias, stupidity, injudicial conduct and much else in court recently. There is more to the bare bones of the news report than meets the eye. But when the government decides the courts cannot be depended upon to decide on defamation damages and on judicial discretion in contempt of court, and wants to codify the provisions, the genteel words exchanged hides not the bitter enmity between the law minister in charge of tables and chairs and the holiday companion of Tan Sri Vincent Tan’s bodyguard and lawyer surfaces ineluctably..

    Into this exchange, this “international business man of unquestioned repute” (IBOUR) — if you would rather believe what his counsel thinks of him — or “Yang Berbahagia Tan Sri Dato’ Seri Vincent Tan Chee Yioun” (YBTSDSVTCY) — in his solicitor’s considered view — decides his satrap Big Chief Injustice needs his help. So he cocks a snook at the government, the dispenser of his patronage, and a day after Dato’ Seri Rais’ defamation concerns, he goes in for the kill. He instructs his solicitors, Messrs Adam Bachek & (sic) Associates, to demand his Shylockian pound of flesh, the one Dato’ Rais was concerned about, demands the RM2,000,000 the federal court awarded in a case in which his counsel wrote part or all of the High Court judgement, went on holidays with Big Chief Injustice and his bodyguard, and argued the Federal Court appeal before him. Tun Eusoff further strengthened his well-honed injustice when he insisted upon delivering the judgement after my counsel had wanted him recused for his biasness, after insisting there would be three separate judgements, and assuring the Bar Council a few months later and two years before a court flunky delivered judgement on his behalf. Fools rush in where angels fear to tread. Well that describes IBOUR YBTSDSVTCY perfectly. However, he looks at it, this demand for monopoly money misses the point.

    He realises not — he should — UMNO turns against him. His enviable political connexions gets government privatisation projects and a cushion from the normal rules of businesses, thousands of acres of pristine land on a silver platter from several states, and except for gambling concessions made a mess of it all. He was awarded the Indah Water Konsortium concession, made a rumoured RM1.2 billion re-selling, ensured it would not succeed and the government has since re-nationalised it. His billion-ringgit project for Kuala Lumpur’s monorail, which despite a further starting grant of RM300 million after an undisclosed grant of similar proportions, should have been ready for the Commonwealth Games in 1998, but today all he can show for it is an abandoned mess of unlinked solitary pillars, which doubles up as well-placed advertising boards for his struggling, barely profitable telecommunication company. He got the greenlight to build the world’s only linear city, over the Sungei Klang, That is another billion and more ringgit worth. But he does not talk about it any more. He got 30 hectares, or thereabout, of beachland in Pulau Redang, off Trengganu, at less than RM1,000 per hectare, with a grateful government displacing the fishermen living there, who now have to walk down a hill to work. That is the subject of an official internal Trengganu investigation.

    He believes, as a business man, he should be allowed to subborn justice. His mad crusade against a Malaysian journalist, Mr Ganesh Sahathevan, fought through the Industrial Court in Kuala Lumpur and the courts in Sydney, Australia, along with suits for hundreds of millions of ringgit in defamation damages, which began with his attempt to shut me up, continues. He has had the law changed, tried to in New South Wales to shut Mr Sahathevan up but the state authorities have stepped in. And he sues in Taipeh for the return of a few hundred million ringgit in bribes for a gambling licence he did not get. UMNO wags refer to him as the ultimate Bumiputra. In a sense, he is. UMNO wants to know how he could get all these lucrative concessions, getting another when each fails, as in almost every case. Which, I contend, is why he goes around trying to silence one and every who dares question his flips and flops. He thought his friendship with the Prime Minister and the finance minister, Tun Daim Zainuddin, would sustain him. He wanted Malaysian businss men’s eternal gratitude by ensuring that business men can control the courts. He won the RM2,000,000 award with neither evidence or witness, producing neither evidence nor witnesses, getting his lawyer to write the judgement and other traversities. He thought he succeeded. Then the law minister comes to change the ground rules once again. And worms turn. Even fat ones like a M.G.G. Pillai or intrusive Ganesh Sahathevans. But then would a former insurance agent who becomes an international business men of unquestioned repute would not know that, would he?

    Abdullah, let M be the LAST witness only after the other five are through. Let him wait with his mouth shut legally about the case. Let the case drag on a bit and stretch his patience. Let witnesses give their statements about him that he could only answer to in court. Let him have a taste of his own medicine.

    Anyway, would Lina Joy’s case be reviewed? ex CJ Fairuz gave a judgement that basically agreed with the government’s official stock and barrel. The dissenting judgement was more solidly written and was done in English, something the ex CJ seemed to be struggling with.
