So, what’s happening around the courts these days?

Tenaganita director Irene Fernandez won her defamation suit against Malay-language daily Utusan Malaysia this morning. She won RM200,000. This is the second case involving activists or the opposition in less than 2 weeks. The first was Malek Hussein, who was illegally detained in 1998 under ISA (he won RM2.5 million).

Are the courts independent after all?

But Chief Justice Ahmad Fairuz Sheikh Abdul Halim must still resign over the Lingam video fiasco. The clip shows senior lawyer VK Lingam purportedly fixing judicial appointments and judgments in 2002 with him. Any Chief Justice will do just that – hand in his resignation – after so much aspersion have been cast over his integrity and credibility. But not a Malaysian CJ, I would say.

Does he think he can escape now by just pleasing activists with money?

    Same as all government corrupted and lazy staffs……get scolding or being visited by senior very hard and show great change. Once the cat is away…all become mices and back to their old habits.
    Traffic policemen are famous for this. Right now…road is being blocked illegally at SS2/4 Subang Jaya by another police bangalow house owner…..caring two hoots what others will say.
    Sad to see such mentalities and high handed attitudes from high ranking police personnel.
    They are so rich…why block public roads for their celebrations? Why not hire a hall? Who do the think they are?

    Malaysian authoritarian “principles” of holding office feature the Cling-On propensity in the forefront – as long as the top support is there. It’s not based on propriety, integrity or subsequently, pronounced public perception.

    It’s based this sort of established presumption, “You can touch me because I’m big! What’s public opiniion? The MSM apologists spins will take care of that.”

    Its a sick, sick world when someone expects a reward for doing what he is supposed to do in the first place – like dispensing justice.

    Its a sick, sick world when justice is served, it is not a normal thing and became a headline.

    Its a sick, sick world when in those rare circumstances when justice is seen to be served, we have this nagging feeling that we are in the process of being cheated big time before day’s end.

    jeancumlately…..MALAYSIA has turned to be most most hypocritical country in the world…and yes…we are real sick of those events…be it right or wrong….always done at the time to cover up bigger things…such as that Chief Justice is still around.
    Leave it to UMNO…..they have developed the art ….since May13th incident….blame the communists this and that…then get cornered….admit their wrongs.
    Right now….not cornered on the Lingham tape….so they think….and perform things to please the public. It’s their style….to protect their fellowmen at all cost.
    Bt if it is a MCA or MIC man….just watch the out-come.
    These guys still don’t wake up to realities.
    Have we heard anything from Samy or Ka Ting? BOTH HAVE NO BALLS…still representing Indians and Chinese?….hahahahaha

    So, Badruddin, one of the 3 clowns is at it again. From my observations, having heard a few parliamentary debates myself, I sense that the parliamentary speakers are rather biased towards the opposition. This is certainly a sad state of affairs. whenever insults are thrown at the opposition, the barisan MPs are only given a slap on the wrist, while the speakers of parliament would order the aggrieved party to sit down and at the same time, have their microphones switched off. May I therefore suggest to the members of the opposition to carry megaphones into parliament so that when the speaker switches-off the microphones of the opposition members of the house, then they should shout into their megaphones in order to be heard.

    Speaking as a member of the disabled community, I wish to condemn in the strongest terms the uncultured behaviour of some of the very arrogant barisan MPs. It is no wonder that the government has decided not to telecast or broadcast parliamentary proceedings or more recently even the UMNO general assembly for they know fully well that it will incur the wrath of the public. Throwing insults at opposition MPs by Barisan MPs seems to be a great past time for these uncultured beings for they jolly well know that they are untouchable and that no action can and will be taken against them. If this trend is allowed to continue, then I fear that violence might just erupt one of these days for even restraint has its limits. Fortunately members of the opposition are able to control their emotions to a certain extent. Sometimes when I listen to parliamentary debates, I get the feeling that I am at a circus, what with all the shouting going on.

    Finally, may I remind all right thinking citizens of Malaysia to vote out the Barisan Nasional government for it has overstayed its welcome. Let us give our undivided support to the opposition with the hope that apartheid and corruption will be things of the past. Please remember to come out in full force on November 10th at Dataran Merdeka, the time being 3pm, at a rally that is being organized by the elections watchdog to try and bring about a clean and fair election.

    I recalled one said….it must be by a man who has great inferiority complexes to keep using bombastic words.     Sooooo lets get back to the Chief Justice matter.
    is the title of the interview on Nazri at Sunday Times..two full pages.
    He said…so many things..but what I like is his reply to the walk by lawyers.He said what is 1000 out of 13.000 protesting. He even said…even majority 7000 took to the street ..not important.
    Then he try to cut off this matter by saying the CJ is about to retire himself.
    On bloggers..he said not important and he does not read blogs. On this I can give him the benefit of doubt…but if in blogging we can pull few thousand votes away from UMNO….then it is a job well done.

    Irene truly deserves this judgement. She dared to go and do what many would have just frowned (Reminds me of Capt Kirk). Who really cares of foreigners and the horrible ways they were treated. We have descended to very low levels in a humanity index. Kudos to Irene. Against all odds she stood her ground. Irene, you have made Malaysia proud.

    Looks like such an important subject has reached its sunset. I notice there is hardly any response after November 2, 2007. What is happening to the “paper activists”? The country needs your views.

    Firstly I would like to congratulate Zaid Ibrahim who has been appointed as the Minister of Legal Affairs in the PM’s Department. Before March 8, 2008, I surmised that ZI would not be nominated for the election and I was correct. A man of vision and one who does not need a job. I guess he is a sincere guy but whether the UMNO guys and girls are able to work and see eye to eye with him is another big question mark? ZI speaks his mind and the truth and that is why the general membership did not like him for his guts. How I wish we have 10 ministers like ZI, the country will be in good hands.

    For his audacity to think and propound of getting the BN leadership to apologise to the sacked LP and his merry lads was something which BN would never stoop that low to do particularly after being made to swallow two humber pies in matter of weeks.

    Judiciary independence is very important in a democracy. Once it is tainted, the public will lose faith in the justice system. I sincerely hope that ZI could propose to the BN leaders to for a Royal Commission for the reformation of the Judiciary. We need to clean up all the skeletons, do away with the cronyistic manner in appointing judges, restore the power of the High Court to hear and determine cases concerning religious matters for the Non-Muslims. Judges should never be driven to a situation where they act in fear. Judges must be appointed accordding to their qualifications, experiences and other qualities. They must be able to write out cases and not rely on litigating lawyers to write out the cases on their behalves.

    Alleged corruption in the judiciary must be acted upon delay, fear or favour. Judges found guilty of graft should be sacked and shall loose their pensions.

    Well ZI the ball is at your feet. The public will judge you by the philosophies that you propounded in your book, “In Good Faith”. Act accordingly and you will find great support from the bloggers who can be a force to be reckoned with.
